This Privacy Policy explains how AUCNET America, LLC ("Aucnet America," "we," "us") collects, uses, and shares information when you visit aucnetamerica.com (the "Site") or apply for and use our membership services.

Our services are provided to businesses (B2B). This policy covers personal information of individuals — such as business owners, applicants, and business contacts — that we handle in that context.

1. Information We Collect

(collectively, “Member Information”):

  • Application Information: name, business name, email, phone, business address, and business details you submit through our application form

  • Verification Documents: your state-issued Resale Certificate and proof of business registration, submitted as PDF files (we do not collect physical originals)

  • Contact form submissions: name, email, phone, and the content of your message

  • Transaction and Account Information once you become a member, as described in the Membership Agreement

Information collected automatically:

  • Standard web analytics data such as IP address, browser type, pages viewed, and referring URLs, collected via cookies and similar technologies

We do not knowingly collect personal information from individuals under 16. The Site and our services are directed to businesses.

2. How We Use Information

We use the information we collect to:

  • Review and verify membership applications

  • Provide, operate, and support member services (auctions, wholesale purchasing, onboarding)

  • Process payments and manage invoices

  • Communicate with you about your application, account, transactions, and our services

  • Maintain records required for legal, tax, and audit purposes

  • Improve the Site and our services

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

3. How We Share Information

  • Within the Aucnet group: with our parent company AUCNET INC. (Japan) for the purpose of providing the services and fulfilling the Membership Agreement

  • Service providers: vendors that support our operations — such as form processing, payment processing, scheduling, and web hosting — under obligations to protect your information

  • Legal: when required by law, regulation, legal process, or to protect rights, safety, and property

4. International Data Transfer and Storage

Your information, including Verification Documents, is stored on servers managed by AUCNET INC. in Japan, organized by member number. By submitting your information, you acknowledge that it will be transferred to and processed in Japan, where data protection laws may differ from those of the United States. We maintain safeguards designed to protect your information regardless of where it is processed.

5. Data Retention

We retain Member Information, including Verification Documents, for the duration of your membership and for three (3) years after termination of membership, consistent with transaction record-keeping requirements, after which it is deleted or de-identified. Contact form submissions from non-members are retained for up to two (2) years.

6. Security

We use reasonable administrative, technical, and organizational measures to protect your information, including access controls on document storage. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Privacy Choices

We provide the following choices regarding your personal information as a matter of our business practices, even though the California Consumer Privacy Act (as amended) does not currently apply to Aucnet America. You may:

  • Ask what personal information we collect, use, and share

  • Request access to the personal information we hold about you

  • Request correction of inaccurate personal information

  • Request deletion of your personal information, subject to legal exceptions (e.g., records we must retain for transactions and compliance)

We will not discriminate against you for making any of these requests.

We do not sell your personal information or share it for targeted advertising, so no opt-out is needed.

To make a request, contact us at acpusa_info@aucnet.com with the subject line “Privacy Request.” We will verify your identity before responding and reply within a reasonable time. You may designate an authorized agent to make a request on your behalf.

8. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last updated” date reflects the most recent revision. Material changes will be communicated to members by email.
